Lists of Sheriff's Sales
THE SCOTT COUNTY SHERIFF’S OFFICE DOES NOT PROVIDE A LIST OF SALES.
Laws and rules of civil procedures control how each sale is handled. The Sheriff acts as a third party/auctioneer under statute to facilitate these sales.
The Sheriff’s Office conducts several different types of sales:
-
Mortgage Foreclosure Sales,
-
Mechanic’s Lien Sales,
-
Writ of Execution (personal or real property),
-
Judgment and Decree Sales
Each one of these sales has many different requirements for notification. Use the links above for specifics on each type of sale.
If the sale notice is to be posted as per civil procedure law, it will be posted in three locations within Scott County.
Mortgage Foreclosures:
For published mortgage foreclosures notices, refer to any of the newspapers published within Scott County: Belle Plaine Herald, Jordan Independent, Prior Lake American, Savage Pacer and Shakopee Valley News. The only exception is the New Prague Times because the physical location of the newspaper office is not in Scott County.
Mechanic’s Lien Sales:
Mechanic’s lien sales are published 3 consecutive weeks in one of the above listed newspapers in the legal notices section. Publishing the notice is the responsibility of the lien holder; and the publishing newspaper is at the lien holder’s discretion. These notices are not posted.
Writ of Execution Sales:
Depending on the type of Writ of Execution sale, publishing and posting vary. If the type of sale requires posting, it will be posted in 3 locations. If it requires publishing, it will be published in one of the newspapers listed above.
Sales may not always happen.
Just because sale notices are published and/or posted, the sale may not happen for a variety of reasons. For example, the sale may not occur if:
-
A representative of the mortgage company is not present,
-
The loan is reinstated,
-
Bankruptcy is declared,
-
For some other reason acceptable per civil process law.
Sales may be cancelled right up to the moment the sale is scheduled to occur.
Previous Sales

Note: The Sheriff’s Office only executes sales. It is not the lien holding forcing the actions. If you need legal advice, contact an attorney. Our office is not permitted to provide legal advice nor can we recommend any specific attorney.
