Forfeitures of Vehicles and
Property
Minnesota state law allows for the forfeiture of vehicles, money and personal property which is involved with certain crimes. The most common occurrences involve arrests for DWI (driving while impaired) and drugs.
The majority of forfeitures involve the seizure of vehicles. The following are some commonly asked questions involving vehicle forfeitures.
Can I get my vehicle back?
The Sheriff’s Office will hold the vehicle until the forfeiture process in complete.
Can I retrieve personal property from the vehicle?
You must contact the Scott County Attorney Forfeiture Unit at 952-496-8200 to review if the property can be returned to you at this time.
How much does the towing and storage fee cost?
The Sheriff’s Office has a storage fee of $15 a day, with a maximum of $75. Added to this cost is the towing fee which is the amount billed to the Sheriff’s Office by which ever towing company is used. All storage and towing fees must be paid before the vehicle will be released.
How can the vehicle be forfeited if the driver is not the owner of the vehicle?
Minnesota state law allows for forfeiture in certain instances where the driver is not the registered owner.
What happens to the vehicles that are forfeited?
The vehicle is either kept for official use by the Sheriff’s Office or sold.
