General Information

The Office of the County Recorder was established by the Territorial Legislature in 1853, its duties modeled after those of the same office in the Territory of Wisconsin, which in turn was modeled after the Office of Recorder in the Old Northwest Territory.

The County Recorder is custodian of all records of the county pertaining to property titles and transfers. In Scott County the records date back to the 1850’s. The original purpose in establishing the office of the County Recorder and the Registrar of Titles was to provide a safe and convenient place where all valuable documents could be filed and recorded. This would make the document a matter of public record, available to all interested parties; and if the original were lost, stolen, or inadvertently destroyed, a certified copy of such an instrument could be obtained. County Recorder implies that – the recorder registers, records, or files documents brought to her office to be made a matter of public record. The Scott County Recorder’s Office operates under the Race Notice Law. This literally means that the person who wins the race to the Office with his/her documents established his/her interest first. It’s as simple as that and as important as that.

The statutory functions of the Recorder's Office are now vested with the County Board. By resolution the Board appoints individual(s) to fulfill these statutory obligations. The Recorder oversees the filings of documents relating to Real Estate, and Vital Statistics. This office also provides direct services to the public by phone and in person for individuals who are researching these transactions.
The real estate recordings must be completed and the instrument returned to the proper person within sixty days of its entry.

In Minnesota, the Recorder is also the Registrar of Titles under the Torrens System. The Registrar is at all times under the control of the District Court which may adopt such rules governing the conduct of the office as it deems advisable. One or more competent attorneys in the County may be appointed by the Judge of the District Court as examiners of titles and legal advisors of the Registrar. This title is guaranteed by the county and it's Board of Commissioners.

As of January 1, 1999, the County Recorder in Scott County is an appointed position.
